BidBay was launched in January 2000, after its founder George Tannous became disenchanted with eBay because of its “unfriendly attitude and lack of service,” BidBay’s web site explains.
Mr Tannous, who bought the BidBay domain name for $1,000 through an auction on eBay, has denied that he copied eBay’s design and has called the
BidBay through its attorney told BBC News Online that it did not wish to comment on the lawsuit until it had received a copy of the complaint.
For its part, eBay’s Monahan said BidBay’s efforts in recent months in which it adopted a colourful logo and content that mirrors eBay’s pushed the company to pursue legal action

The deal means that although the old Sothebys.com site will continue to present the art, antiques and jewellery it presently displays, it will cease to be a separate entity, instead appearing within eBay.
That gives Sotheby’s access to eBay’s bidding technology, and means that bidders worldwide could conceivably participate in offline auctions at Sotheby’s rooms in New York and London.
EBay has already ventured into the fine arts world by buying Butterfield and Butterfield, a smaller competitor of Sotheby’s in 1999.
Sotheby’s was at pains to stress that real-world auctions, complete with nods and winks, gavels and auction blocks, will remain the core of the business.

A spokeswoman for the Department of Health said: “The actual ban on advertising will still come in from December 10 but these changes help corner shops and other retailers to comply.”
But Professor Gordon McVie, director general of the Cancer Research Campaign, said: “Frankly, I am extremely disappointed. I do not understand why they have done this and I cannot believe the TMA had any possible argument to put forward for a delay that could carry any weight.
“The ban on advertising was one of Labour’s pillars of policy and I simply do not understand why they are doing this.”
Ash director Clive Bates said: “I don’t know why the government is bending over backwards to appease the tobacco industry with these concessions.
Across non-smokers and smokers, there was generally significantly more support for the smoking ban in restaurants than pubs.
Only 6% of smokers said they wanted to give up because of the ban on lighting up in public places, which was introduced in England in mid-2007, and slightly earlier in Scotland and Wales.
The vast majority of would-be quitters said they were motivated by health reasons. Nearly a third said they wanted to give up because they could not afford it or considered it a waste of money.
A packet of 20 cigarettes now cost nearly £6.
Dr Jennifer Mindell from the Faculty of Public Health said the drop in the numbers wanting to quit showed 2007 was “basically a blip”.
“It’s more or less what we would have expected. The smoking ban was a good trigger for some people but many people quickly realised they could carry on smoking.

The second largest US stock market, the Nasdaq, which specialises in high technology companies, is planning to become a public, profit-making company.
The news came after a meeting of the National Association of Security Dealers, which owns the exchange, in New York. It may ultimately consider a stock market flotation, but intially new investment will come from the broker-dealers who currently handle its trades.
Frank Zarb, chairman of the Nasd, said that he wanted to encourage the full use of new technology.
“The market model we will end up with will bring in the people who bring revenues to the Nasdaq and that’s important. If we do it right, the value of the Nasdaq will increase.”

President Valdis Zatlers has again taken the unusual step of calling a special meeting of the Cabinet of Ministers, this time asking Latvian government officials to update him on their planned reforms.
Zatlers has set the meeting for Sept. 15, the president’s press office announced Sept. 2. Prime Minister Valdis Dombrovskis and five other ministers are expected at the meeting.
In April, the president called a special meeting in which he asked the prime minister and two other ministers to address government reforms in the face of the global economic crisis, which has hit Latvia particularly hard. Since then, Latvia’s economy has worsened and, under pressure from the International Monetary Fund and other lenders, the government has been forced to deeply slash the state budget in an effort to avoid going broke.
Cuts to education and health funding, among others, have resulted in demonstrations. An estimated 200 residents of Bauska blocked traffic Aug. 31 in protest over reorganization of the local hospital, while hundreds of teachers demonstrated Sept. 1 in Rīga across the street from the Cabinet of Ministers building.

Guatemalan President Alvaro Colom has declared a state of national calamity because so many citizens do not have food or proper nutrition.
Speaking in a nationally televised address late Tuesday, Colom said his declaration will make it easier to get food to the thousands of Guatemalan families who are in dire need.
“This will help us access resources from the international community that are generously offered for this type of situation and to mobilize national resources more rapidly,” he said.
The United Nations’ World Food Programme says Guatemala has the fourth highest rate of chronic malnutrition in the world and the highest in Latin America and the Caribbean. Chronic undernutrition affects about half of the nation’s children under the age of 5, the U.N. agency said.
Colom said the nation’s food problems are the result of a drought this year, global warming and the effects of the international economic crisis. He also cited the Central American nation’s “history of unfairness that has made Guatemala live since long ago with high and shameful poverty levels, extreme poverty and undernutrition.”
According to the World Bank, about 75 percent of Guatemalans live below the poverty level, which is defined as an income that is not sufficient to purchase a basic basket of goods and basic services. Almost 58 percent of the population have incomes below the extreme poverty line, which is defined as the amount needed to purchase a basic basket of food.

Jeans are pants, or trousers, made from denim. Mainly designed for work, they became popular among teenagers starting in the 1950s. Historic brands include Levi’s and Wrangler.
Jeans are now a very popular form of casual dress around the world. They come in many styles and colors; however, “blue jeans” are particularly identified with American culture, especially the American Old West. Trousers made from corduroy or canvas are sometimes incorrectly called jeans. However, traditionally the word “jeans” referred to trousers made exclusively out of denim.
Player sites, good god, they’re awful. They have been for years. I haven’t frequented any of them, ever, because there’s absolutely nothing to learn from them. Nothing to gain about the game. Same with most tweets, from NBA players, and about 95 percent of quotes from NBA types. By and large, if you want to learn about the game, you have to watch the games. Not listen to the participants talk about it.

Ripped jeans are a mark of rebellion. They make the wearer stand out of the crowd and get noticed. Ripped jeans are in high demand among girls and boys alike. To boys, ripped jeans impart a rugged look, while girls wear them because they are simply hip.
Ripped jeans are the funkiest type of jeans. Made popular by rock stars in the 1960s, ripped jeans are back in fashion. Today, more and more celebrities are seen sporting the ‘I don’t care’ look with their ripped jeans. Even Britney Spears wore ripped jeans for her rushed-for-the-media Las Vegas wedding.
